Limited Warranty

Exponential Property Materials, LLC (“Exist Multifamily”) offers this limited warranty for all materials furnished in connection with the referenced project. Exist Multifamily warrants that the supplied products will be free from defects in materials and workmanship for a period of one (1) year commencing from the date stated on the Final Certificate of Occupancy for the building or the relevant portion where the products are installed (the “Warranty Period”).

Should any defects in covered materials or workmanship arise during the Warranty Period, Exist Multi Family will, at its sole discretion, repair, replace, or refund the purchase price of the defective product. This limited warranty represents the exclusive remedy available to the purchaser and applies strictly within the Warranty Period.

Exist Multifamily is not liable for any incidental, indirect, or consequential damages. No remedy other than those identified above shall be available for any purchaser of goods from Exist Multifamily, and then only during the Warranty Period.

Other than as specifically stated, no additional warranties, whether express or implied—including any warranties of merchantability or fitness for a particular purpose—are provided. Warranty coverage applies solely to goods for which payment in full has been received. No warranty extends beyond the terms described herein.

Terms & Conditions

1. Pricing and Payment

All pricing provided by Exist Multifamily Cabinet & Stone Factory is subject to change until a written proposal or contract has been formally accepted by the purchaser. Production will begin only upon receipt of the required deposit or initial payment as specified in the proposal. The remaining balance must be paid upon delivery of the materials unless other payment arrangements have been expressly agreed to in writing by both parties. Ownership and title to all goods sold will remain with Exist Multifamily until the full payment has been received and cleared. Failure to remit final payment on time may result in delays, storage fees, or withholding of delivery. Accepted payment methods and any applicable fees will be disclosed prior to invoicing.

2. Delivery and Storage

Purchasers are required to accept delivery of their completed order within thirty (30) days of being notified that materials are ready. If delivery or pickup is not completed within this timeframe, storage fees may apply, and Exist Multifamily reserves the right to assess additional charges or release the materials from storage at the purchaser’s expense. Once delivery has been made, ownership and risk of loss transfer to the purchaser. While delivery schedules and timelines are estimated in good faith, Exist Multifamily is not liable for delays arising from transportation issues, material shortages, labor disruptions, or other conditions beyond the company’s control. Customers are encouraged to coordinate installation or construction schedules accordingly.

3. Installation

Installation services, when included, will be performed in accordance with the written proposal or project specifications. The purchaser is responsible for ensuring that the installation site is clean, safe, and accessible at the scheduled time. This includes providing adequate workspace, utilities, and structural readiness before labor begins. Any unexpected site conditions—such as uneven walls, plumbing or electrical conflicts, or obstacles not disclosed in advance—may result in delays and additional charges. Installation timelines are dependent on each project’s conditions, and Exist Multifamily reserves the right to reschedule should circumstances prevent safe or proper installation.

4. Inspection and Acceptance

All delivered materials must be inspected by the purchaser within seventy-two (72) hours of receipt. Any claims of damage, shortage, or nonconformity must be reported in writing during this period, accompanied by photographs or a detailed description. If no claim is made within the inspection window, acceptance is deemed complete either after seventy-two hours or upon installation, whichever occurs first. Once materials have been installed, modified, or used, they are considered accepted in good condition and no longer eligible for return under normal circumstances.

5. Returns and Cancellations

All sales are considered final upon confirmation of order and payment. Returns or replacements will only be accepted for defective or non-conforming goods as defined by the terms of the warranty. Because many products are custom-made to client specifications, orders cannot be canceled once production has begun. Requests for order modifications must be submitted in writing and approved before production starts. Approved returns may be subject to restocking fees or shipping costs, which will be communicated in advance.

6. Limitation of Liability

Exist Multifamily liability, whether in contract, tort, or otherwise, is strictly limited to the remedies specified in this document. Under no circumstances will Exist Multifamily be held responsible for incidental, consequential, or indirect damages such as lost profits, project delays, or labor costs incurred by the purchaser or third parties. The purchaser’s exclusive remedy for any claim arising out of the purchase or use of products is limited to the replacement, repair, or refund of the affected goods, as determined by Exist Multifamily.

7. Force Majeure

Exist Multifamily will not be liable for failure or delay in performance caused by events beyond its reasonable control. Such events include, but are not limited to, natural disasters, extreme weather, fire, flood, war, labor disputes, pandemic conditions, or supply chain disruptions affecting material availability. In such cases, deadlines may be extended, and both parties will make reasonable efforts to minimize delays and resume normal operations as soon as practicable.

8. Entire Agreement

These Terms and Conditions represent the entire agreement between Exist Multifamily Cabinet & Stone Factory and the purchaser and supersede any prior written or verbal agreements, correspondence, or representations regarding the same subject matter. Any amendments or modifications must be made in writing and signed by authorized representatives of both parties to be valid. Acceptance of a proposal, invoice, or work order constitutes acknowledgment and agreement to these terms in full.
